These Terms of Use ("Terms") govern your access to and use of the Eloise app (the "Service"), operated by Product Minded, a UK-based entity ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Your Responsibilities

By using Eloise, you agree not to use the service to:

• Create, share, or promote content that is abusive, hateful, harassing, violent, threatening, discriminatory, sexually explicit, or otherwise inappropriate.
• Target individuals, groups, or organizations in a way that could reasonably be seen as bullying, defamation, or harassment.
• Impersonate someone else or misrepresent your affiliation with any person or entity.
• Share links, names, or content that are deceptive, misleading, or malicious (e.g., phishing or spam).
• Interfere with the operation of the service, including by attempting to manipulate results or bypass voting limits.
• Submit content that contains personal or sensitive information about others without their explicit consent.

Content Moderation and Removal

We reserve the right to:

• Remove or modify any content at our sole discretion, without notice, especially if we believe it violates these Terms.
• Suspend or block access to the service by any user or IP address associated with abuse.
• Delete any data associated with abusive behavior.
• Suspend or terminate access to the Service at any time, with or without notice, for any reason, including maintenance, legal compliance, or user misconduct.

While we do not moderate or endorse user-generated content, we take violations seriously and encourage users to report inappropriate material.

Data and Privacy

We may store and process limited data (such as votes, questions, and IP addresses) in accordance with our Privacy Policy.

We use third-party providers, including Vercel (hosting) and Supabase (database), which may store data in the UK, EU, and USA. By using the service, you consent to this processing.

We take reasonable technical and organizational measures to protect the security of your data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Intellectual Property

All content generated by users (such as names, questions, and options) remains the property of the user who created it. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely for the purpose of operating and improving the Service.

The name "Eloise," its logo, and all original content and software on the Service are the property of the Service provider and may not be copied, reproduced, or used without permission.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, reliability, or completeness of any results or content.

We do not guarantee that the Service will be available at all times or free of errors. You use the Service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, profits, or reputation.

In no case shall our total liability exceed £100 or the amount you paid to use the Service, whichever is greater.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the UK courts.
